LAW-2039 Resolution of Private Intl Disputes
This course will explore key legal issues that arise in resolving private transnational disputes, with emphasis on US law and references to relevant international treaties, certain comparative cases, and international law. We will first consider several complex adjudicatory problems in the context of transnational litigation. Next, we will commence study of issues involving international commercial arbitration (and mediation). We will look at US law doctrines in support of arbitration, particular issues that arise between arbitration and the courts, and then recognition and enforcement of both foreign judgments and foreign arbitral awards.
