LAW-2593 Title IX in Practice: Compliance, Enforcement, and Institutional Response
This course examines Title IX from the perspective of lawyers and professionals who advise educational institutions, investigate complaints, and navigate the law's evolving regulatory landscape. We will begin with the history of Title IX, tracing its statutory origins, implementing regulations, and significant judicial and administrative developments. We will consider how changes in federal regulations, agency guidance, and court decisions have shaped institutions' obligations over time, with particular attention to the role of the U.S. Department of Education's Office for Civil Rights (OCR) in enforcing Title IX. Building on this foundation, we will explore the substantive scope of Title IX and the obligations it imposes on schools, colleges, and universities. Topics will include sexual harassment and sexual violence, athletics, and the applicability to pregnant and parenting students, employees, and transgender students, as well as the legal standards governing institutional responses to reports of sex discrimination. We will examine grievance procedures, investigations, supportive measures, remedies, and compliance responsibilities, while considering the practical challenges institutions face in balancing legal obligations with educational missions. Throughout the course, we will examine the relationship between Title IX and other federal civil rights laws, including Titles VI and VII of the Civil Rights Act, and consider how overlapping legal frameworks affect institutional decision-making. Through case studies, policy analysis, and practical exercises, students will develop the skills necessary to advise educational institutions, evaluate compliance, and respond effectively to the complex legal issues that arise under Title IX.
