LAW-2288 Mediation

One of a lawyer's primary tasks is to help clients resolve disputes. Most controversies are never decided by a court, but instead are settled through other methods. The ability to choose among and support clients in alternative processes effectively is crucial for litigators as well as transactional lawyers. This course introduces the fundamentals of mediation and a mediation mindset.  Students will learn basic mediation skills and then put them to practice with role-plays.  Class time will also introduce related topics, such as bringing in neutral experts, working with high-conflict clients, the importance of safeguarding client dignity, and ethical challenges. Attendance and participation in class, as well as a full-day role play which occurs on a Saturday towards the end of the semester, are integral to the learning experience and part of the grading criteria.
