LAW-9023 International Human Rights and Comparative Law Critique of US Federal Indian Law
This course will examine the foundational principles of US Federal Indian Law, and then engage in a critical assessment of those principles utilizing international human rights and comparative cases. With a focus on historic US federal policies toward native peoples that emphasized assimilation and termination of the government-to-government relationship with tribal governments, the course will also consider the similarities with Ireland's historical experiences related to loss of lands, cultural assimilation and preservation of language. Finally, this course will introduce practical legal skills, specifically case strategy development, related to international human rights advocacy by reading case studies of past and current cases of Suffolk's Human Rights and Indigenous Peoples Clinic.
